General Terms and Conditions of Sale

Version 2026-10-10. This English version is provided for information only: the French version is the only legally binding one.

Article 1 — Purpose and scope

These General Terms and Conditions of Sale (“Terms”) govern the sale of personalised printed recipe books and digital PDF files (the “Products”) through the CookMateBook website by Maadinfo Services, [À COMPLÉTER], SIREN 788 421 311 - R.C.S. Grasse, 2 allée des ormeaux, 06130 Grasse, France, VAT FR37788421311 (the “Seller”), to any person placing an order (the “Customer”).

Placing an order implies full acceptance of these Terms, which the Customer acknowledges having read before confirming the order. A “consumer” is any natural person acting for purposes outside their commercial, industrial, craft, liberal or agricultural activity. Provisions specific to consumers do not apply to businesses.

Article 2 — Products

The Customer builds their book by importing recipes and arranging them on page templates. The main characteristics (format, page count, paper, binding, cover, quantity) are shown when the order is configured.

On-screen renderings are not contractual: slight colour differences between screen and print (notably due to CMYK conversion) are inherent to the printing process and are not a defect.

The Customer is solely responsible for proofreading their book (content, spelling, layout, image quality and resolution) before confirming. The preview provided before ordering constitutes the approved proof.

Article 3 — Account

Ordering requires a user account (authentication through CookMate). The Customer guarantees that the information provided, notably the delivery address, is accurate and remains responsible for keeping their credentials confidential.

Article 4 — Customer content

The Customer declares that they hold all rights (copyright, image rights, trademarks, etc.) over the texts, recipes, images and other content included in their book, and indemnifies the Seller against any third-party claim in this respect.

The Customer grants the Seller a non-exclusive reproduction licence, limited to the duration and purposes necessary to fulfil the order (file generation, printing, shipping, retention of proof).

The Seller and its printer reserve the right to refuse or cancel, with a refund, any order whose content is manifestly unlawful (infringing, hateful, pornographic, defamatory or contrary to public order) or technically unprintable.

Article 5 — Prices

Prices are shown in the currency displayed at checkout, including all taxes, with the VAT applicable in the country of delivery included in accordance with current regulations; the breakdown excluding VAT / VAT appears on the invoice.

The manufacturing price, delivery costs and total are displayed before the order is confirmed. Customs duties and import taxes that may be due in some non-EU countries are borne by the Customer.

The Seller may change its prices at any time; the price applicable is the one displayed at the time of the order.

Article 6 — Ordering

The ordering steps are: book configuration, entering addresses, choosing a delivery method, summary (Products, price including taxes, delivery costs, estimated lead time), acceptance of the Terms, clicking the order button, then payment. Before confirming, the Customer can check and correct their order.

The contract is concluded when payment is confirmed, evidenced by a confirmation email. The Seller may refuse or cancel an order for a legitimate reason (previous dispute, non-payment, unlawful content, non-served country), with a full refund.

The Seller keeps order and invoicing data for 10 years; the Customer can access it from their account. The Seller’s computerised records are evidence between the parties, unless proven otherwise.

Article 7 — Payment

Payment is made online by bank card through Stripe, in full at the time of the order. Transactions are secured; the Seller has no access to full card details.

If payment is refused or not completed within 30 minutes, the payment session expires and the order is not processed. The Seller remains the owner of the Product until full payment.

Article 8 — Manufacturing and delivery

Books are printed on demand by a service provider and then shipped to the address given by the Customer, in the countries offered at checkout. The lead times shown in the summary (manufacturing and transport, depending on the chosen method) are indicative.

Unless otherwise specified, delivery takes place no later than 30 days after the contract is concluded (article L216-1 of the French Consumer Code). In case of delay, the Customer may call on the Seller to deliver within an additional reasonable period; failing that, they may terminate the contract in writing and be refunded within 14 days (articles L216-2 and L216-3).

Risk passes upon physical handover of the parcel to the Customer or to a third party designated by them (article L216-4). The Customer must check the condition of the parcel on receipt and, in case of damage or missing items, make reservations with the carrier and inform the Seller within 7 days at contact@cookmatebook.com. A parcel that cannot be delivered because of an incorrect or incomplete address, refusal or non-collection may be returned at the Customer’s expense.

Digital product: the PDF file is made available in the Customer’s account after payment.

Article 9 — Right of withdrawal

9.1 Principle. Under articles L221-18 et seq. of the French Consumer Code, a consumer has 14 days to withdraw from a distance contract without giving a reason.

9.2 Exceptions. Under article L221-28 3°, the right of withdrawal cannot be exercised for goods made to the consumer’s specifications or clearly personalised: CookMateBook printed books, made from the Customer’s own content, fall within this exception.

Under article L221-28 13°, it also cannot be exercised for the supply of digital content not supplied on a tangible medium whose performance has begun after the consumer’s prior express consent and express waiver of their right of withdrawal. By ticking the dedicated box before payment, the Customer requests immediate availability of the PDF and acknowledges losing their right of withdrawal as soon as it is made available.

9.3 Cancellation before manufacturing. As a commercial gesture, the Customer may ask to cancel their order as long as it has not been sent to print, by writing without delay to contact@cookmatebook.com. This is not a right of withdrawal and ends as soon as the order is sent to manufacturing.

Article 10 — Statutory warranties

The Seller is liable for lack of conformity (defective printing, missing pages, faulty binding, damaged product, product not matching the approved order) existing at the time of delivery, under articles L217-3 et seq. of the French Consumer Code. The consumer has 2 years from delivery to act. They may choose between repair (reprint) and replacement, unless the cost is manifestly disproportionate, and failing that obtain a price reduction or termination of the contract. They do not have to prove that the defect existed during the 24 months following delivery of the goods (12 months for digital content).

The warranty does not cover defects resulting from elements approved by the Customer (mistakes, low-resolution images, screen colours, layout approved in the preview).

The consumer also benefits from the warranty against hidden defects (articles 1641 to 1649 of the French Civil Code), which can be exercised within 2 years of their discovery.

For any claim, the Customer writes to contact@cookmatebook.com stating the order number and attaching photographs of the defect; the Seller replies within 5 working days.

Reminder: the consumer benefits from the statutory warranty of conformity (articles L217-3 to L217-20 of the French Consumer Code) and the warranty against hidden defects (articles 1641 to 1649 of the French Civil Code), free of charge.

Article 11 — Printing errors

If a printing error or transport damage is established, the Seller will reprint and reship at no cost or, failing that, refund, without prejudice to the Customer’s other rights.

Article 12 — Refunds

Any refund is made using the same payment method as the order, within a maximum of 14 days after the refund decision.

Article 13 — Liability

The Seller is not liable for delays or failures due to force majeure (article 1218 of the French Civil Code) or to a breach by the Customer. Nothing in these Terms excludes or limits the Seller’s liability in case of wilful misconduct, gross negligence, bodily injury, or where the law prohibits it. Towards businesses, the Seller’s liability is limited to the price paid for the order concerned, excluding indirect damages.

Article 14 — Intellectual property

Page templates, interfaces, software and trademarks of the site remain the property of the Seller and its licensors. The Customer has a personal right of use over the ordered book and may not resell the templates as such.

Article 15 — Personal data

The processing of personal data is described in the legal notice (article 5). The contact details necessary for delivery are passed on to the printer and the carrier.

Article 16 — Customer service and mediation

Customer service: contact@cookmatebook.com. Any claim is first addressed to customer service.

If no solution is found within 2 months, the consumer may use, free of charge, the consumer mediator: [À COMPLÉTER], [À COMPLÉTER], [À COMPLÉTER]. The parties remain free to bring the matter before the competent court.

Article 17 — Governing law and disputes

These Terms and the sale are governed by French law, without prejudice to the mandatory consumer-protection provisions of the consumer’s country of residence within the European Union. The consumer may bring proceedings, at their choice, before the court of their place of residence or the place of actual delivery of the goods (article R631-3 of the French Consumer Code). For businesses, the courts of the Seller’s registered office have exclusive jurisdiction.

Article 18 — Changes to the Terms and language

The Terms applicable are those in force on the date of the order; earlier versions remain available on request. Only the French version is binding; translations are provided for information.

Article 19 — Acceptance

The Customer acknowledges having read and accepted the Terms before placing an order, by ticking the box provided. The date and version of the Terms accepted are recorded with the order.
